Loan Terms and Conditions

Please read these Terms together with the loan-specific Disclosure Statement and Repayment Schedule shown in the App before accepting a loan.

1. Agreement and Parties

These Loan Terms and Conditions (the “Terms”) govern loans applied for through the Mabilis Cash mobile application (the “App”).

The lender is Fcash Global Lending Inc., SEC Registration No. CS201803813, Certificate of Authority No. 2653. Address: Unit D No. 41 12th Street, New Manila, Quezon City, Metro Manila, 1100 Philippines (the “Lender”).

The App is published and operated by RS LIFIX LENDING CORP., SEC Registration No. CS202100657. Address: Ground Floor C5 Bldg, Roxas Avenue, Brgy 32-D (Pob), Davao City, Davao del Sur, Philippines (the “App Operator”).

“Borrower,” “you,” and “your” refer to the person applying for or receiving a loan. The Terms, your loan-specific Disclosure Statement, Repayment Schedule, accepted loan offer, and any promissory note or electronic confirmation together form the “Loan Agreement.” If a loan-specific document conflicts with these general Terms, the loan-specific document controls for that loan, except where prohibited by law.

2. Eligibility

To apply, you must:

  • be at least 18 years old and legally capable of entering into a binding contract;
  • be a resident of the Philippines with a valid Philippine address and contact details;
  • provide a valid government-issued identity document and successfully complete required identity and fraud-prevention checks;
  • provide complete, accurate, and current application information; and
  • satisfy the Lender’s applicable credit, affordability, risk, and compliance requirements.

Meeting these conditions does not guarantee approval. The Lender may approve a lower amount or different term than requested, decline an application, or request additional information, subject to applicable law.

3. Application and Verification

You authorize the Lender and App Operator to verify information you submit and, where legally permitted and appropriately disclosed, obtain identity, fraud, credit, employment, income, bank-account, or other relevant verification information from authorized service providers and sources.

You confirm that all information and documents submitted are true, accurate, complete, and belong to you. False, misleading, altered, or unauthorized information may result in rejection, suspension, termination, investigation, or other lawful action.

The specific amount and term available to you depend on the Lender’s assessment. You are not obligated to accept an offer. The exact approved amount, net proceeds, repayment dates, charges, finance charge, effective interest rate, and total amount payable will be shown before acceptance.

5. Interest Calculation

The contractual interest rate is 0.07% per day. Unless your loan-specific Disclosure Statement expressly provides another lawful method, simple interest is calculated each day on the outstanding principal balance using the following formula:

Interest = Outstanding Principal × 0.0007 × Number of Days

Interest begins on the date stated in your Disclosure Statement and continues until the applicable principal is repaid, subject to the agreed term and applicable law. Interest does not compound unless expressly disclosed, agreed in writing, and permitted by law.

Illustrative examples only

These examples assume simple interest on the original principal, one payment at maturity, no fees, no deductions, and no late payment. Your actual offer may differ.

The daily contractual rate corresponds to a simple nominal annual rate of approximately 25.55% (0.07% × 365). This is not the effective interest rate. The effective interest rate depends on actual cash proceeds, fees, deductions, payment timing, and repayment structure.

6. Loan-Specific Disclosure Statement

Before you accept a loan, the Lender will provide a clear written or electronic Disclosure Statement and Repayment Schedule showing, as applicable:

  1. approved principal amount;
  2. every fee, charge, tax, or deduction, separately itemized;
  3. net loan proceeds you will actually receive;
  4. contractual interest rate and method of calculation;
  5. finance charge stated in Philippine pesos;
  6. effective interest rate reflecting the true cost of the loan;
  7. each payment amount and due date;
  8. total amount payable if paid as scheduled;
  9. late-payment, default, prepayment, or other conditional charges; and
  10. any applicable cooling-off or cancellation right.
Do not accept the offer if any amount, fee, due date, or calculation is unclear. Contact us and request an explanation or corrected disclosure before proceeding.

7. Approval and Disbursement

A loan is approved only when the Lender issues a final offer and you validly accept the Loan Agreement. Displaying an estimated limit or submitting an application does not create a loan obligation.

Approved net proceeds will be transferred to the bank account, electronic wallet, or other disbursement channel identified in your Disclosure Statement. You are responsible for providing correct account details. Any lawful disbursement fee or deduction must be disclosed before acceptance.

8. Repayment

You must pay each amount in full on or before the due date stated in your Repayment Schedule, through an authorized payment channel displayed in the App. A payment is treated as received when cleared and credited to the designated loan account.

Unless the Loan Agreement or applicable law requires another order, payments will be applied first to accrued contractual interest and then to the outstanding principal balance.

You should retain payment receipts and promptly report any missing or incorrectly posted payment.

9. Late Payment and Charges

If you do not make a payment when due, the Lender may impose only those late-payment charges expressly stated in your Disclosure Statement and permitted by applicable law.

If a payment is late, you remain responsible for the overdue principal and any contractual interest that has lawfully accrued. We will not impose any fee, penalty, or charge that was not clearly disclosed and accepted before the loan was issued. All amounts remain subject to applicable regulatory limits.

10. Early Repayment and Cooling-Off

You may repay all or part of the outstanding loan before its scheduled due date without a prepayment fee. Interest will be calculated only through the applicable early-repayment date, and the App will show the amount required to complete the early repayment.

Where applicable law or regulation grants a cooling-off or cancellation period, the App will disclose its duration, how to exercise it, and the amount that must be returned. Exercising a cancellation right does not remove your obligation to return funds already disbursed and pay any amount lawfully due.

11. Events of Default

Subject to notice and applicable law, an event of default may occur if you:

  • fail to pay an amount when due;
  • provide materially false, fraudulent, or misleading information;
  • use another person’s identity or payment account without authority;
  • materially breach the Loan Agreement; or
  • become subject to another event expressly identified in the loan-specific agreement and permitted by law.

Following default, the Lender may demand payment of amounts lawfully due, suspend access to further credit, report information to authorized credit-information systems where permitted, or pursue other lawful remedies. Acceleration of future amounts may occur only if stated in the Loan Agreement and permitted by law.

12. Collection Practices

The Lender, App Operator, and authorized collection providers will use lawful and fair collection methods. They must not use threats, violence, insults, false representations, public shaming, unauthorized disclosure of debt information, or other unfair collection practices.

We may contact you through the contact channels you provided and as permitted by law. We will not access or use your phone contact list or social-media contacts for debt collection unless there is a separate lawful basis, valid consent where required, and full disclosure consistent with applicable rules.

If you experience improper collection conduct, contact us through Section 15 and preserve relevant messages, call records, or other evidence.

13. Personal Data

Personal data is collected and processed according to the Mabilis Cash Privacy Policy, applicable privacy notices, and Philippine data-protection law. The Privacy Policy describes the categories of data collected, purposes, sharing, retention, security, and your rights.

Permission to track under Apple’s App Tracking Transparency framework is optional and is not a condition for obtaining or repaying a loan.

14. Electronic Records and Communications

You agree that applications, disclosures, notices, agreements, confirmations, receipts, and other records may be provided electronically through the App, email, SMS, or another contact channel you provide, subject to applicable law.

Your electronic action—such as selecting an acceptance checkbox, entering a one-time code, using an electronic signature, or pressing an “Accept” or equivalent button—may constitute your signature and agreement. You may download or request a copy of your Loan Agreement and Disclosure Statement.

You must keep your contact information current and protect your device, account credentials, and verification codes from unauthorized access.

Please include your registered contact details, loan reference number, a description of the issue, and relevant supporting records. You may also pursue remedies or submit a complaint to the appropriate Philippine regulator or authority.

16. General Terms

Governing Law

The Loan Agreement is governed by the laws of the Republic of the Philippines. Nothing in these Terms limits a mandatory consumer right, venue, remedy, or protection provided by law.

Assignment

You may not transfer your rights or obligations without the Lender’s written consent. The Lender may transfer or assign rights only as permitted by law and subject to any required notice and continued protection of your rights and personal data.

Changes

Changes to an existing loan require notice and agreement where required by law. General updates will not retroactively increase the interest, fees, or obligations of an already accepted loan unless you expressly agree and the change is lawful.

Severability and No Waiver

If a provision is found invalid or unenforceable, the remaining provisions continue to the extent permitted by law. Delay in exercising a right does not waive that right.

Entire Agreement

The complete Loan Agreement replaces prior statements regarding that loan. Advertising, estimates, or displayed limits do not override the final Disclosure Statement and accepted loan documents.
